Welcome to Pokey Mart (“Company”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and products. By accessing or using our website or any of our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. 1. 1. Our Services
      i) Grading Service
      Pokey Mart offers third-party card grading submission services. All grading service fees are strictly non-refundable. Once a grading order has been submitted and recorded in our system, it is considered final. No changes, cancellations, or refunds will be permitted under any circumstances.
      Pokey Mart is not responsible for any loss, damage, or delays that occur during shipping, whether within Malaysia or internationally. Once your cards have been received by the respective grading companies (PSA, CGC, or TAG), those organizations assume responsibility under their own insurance policies for the duration of the cards’ time in their possession.
      Estimated turnaround times are provided for reference only and are not guaranteed under any circumstances.
      ii) Card Restoration Service
      We offer card cleaning and restoration service to improve the aesthetic condition of your trading cards. However, we do not guarantee perfect or specific results. The effectiveness of restoration depends on the card’s original condition.
      Pokey Mart is not liable for any damages incurred during the cleaning or repair process. This includes human error or natural causes. Pokey Mart reserves the right to compensate customers in the event of proven damage, but such compensation is at our discretion. Fees are applied proportionally to the success rate of the restoration, as detailed in our Return, Refund and Delivery Policy.
      The estimated turnaround time for restoration service is within 30 working days, depending on demand and complexity.
      iii) Products
      All transactions involving the purchase of any products are generally considered final. However, returns, refunds, or exchanges may be permitted only in accordance with our Return, Refund and Delivery Policy, which sets specific eligibility criteria and timeframes
      Certain products or services may be available exclusively online through our website and may have limited quantities. These items remain non-returnable and non refundable unless explicitly eligible under specific circumstances defined in our Return, Refund and Delivery Policy.
      We make every effort to accurately display the images and colors of our products. However, we cannot guarantee that your screen’s display will reflect the actual product color or details.
      Pokey Mart reserves the right to:
      – Limit sales to any individual, region, or jurisdiction;
      – Limit quantities of any product or service;
      – Change product descriptions, pricing, or availability at any time without notice;
      – Discontinue any product or service at our sole discretion;
      – Void any offer where prohibited by law.
      We do not guarantee that the quality of any product or service will meet your expectations, nor that any errors in the service will be corrected.
   2. Account Registration
      To access certain features or services on our website, users may be required to create an account. When registering for an account, you agree to provide accurate, current, and complete information, and to update your details as needed to keep your account information accurate.
      You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. Pokey Mart shall not be held liable for any loss or damage arising from your failure to safeguard your login information. You agree to notify us immediately via our official contact channels if you suspect any unauthorized access or use of your account. We reserve the right to suspend, restrict, or terminate your account at our sole discretion, especially in cases of suspected fraud, misuse, or violation of these Terms.
   3. User Responsibilities
      By using our services, you agree to provide accurate, complete, and current information at all times. You agree to use our services only for lawful purposes and in accordance with these Terms.
      Customers must not submit counterfeit, altered, or fraudulent cards. Any attempt to defraud Pokey Mart may result in suspension of services and potential legal action. We reserve the right to reject or refuse service to users who violate these terms.
      You also agree to respect the outcomes of grading and restoration services, as these processes are inherently subjective and influenced by professional standards.
   4. Payments
      All pricing is listed in Malaysian Ringgit (MYR) and is subject to change without prior notice. We reserve the right to update, adjust, or discontinue any service or pricing at our sole discretion.
      We accept major payment methods as displayed on our website. Full payment must be made prior to the commencement of any service or the shipment of any product. Orders are processed based on availability and acceptance by Pokey Mart.
      We are not liable to you or any third party for any modifications to pricing, discontinuation of services, or website content updates.
   5. Intellectual Property
      All content, designs, text, graphics, logos, and trademarks on our website are the intellectual property of Pokey Mart or its licensors. You may not reproduce, distribute, or use any material without prior written consent from us.
   6. Optional Tools
      We may offer access to third-party tools via our website. These tools are provided “as is” and “as available” without any warranties, support, or endorsement from Pokey Mart. We do not monitor or control these tools and are not liable for any issues that arise from their use.
      Your use of such tools is entirely at your own risk and discretion. Please review and agree to the third-party provider’s terms before using them. Any new tools, features, or services added to our website in the future will also be governed by these Terms of Service.

      Any issues, complaints, or disputes related to third-party products or services should be directed to the respective third party, not to Pokey Mart.
   8. Liability & Disclaimers
      Pokey Mart disclaims all liability for indirect, incidental, or consequential damages that may arise from the use of our services. We are not responsible for:
      – Loss or damage to cards due to shipping or unforeseen circumstances.
      – Discrepancies or subjective dissatisfaction with grading results.
      – Any issue arising from incomplete, incorrect, or outdated information provided by the customer.
      – Undisclosed pre-existing conditions of submitted cards that may impact service outcomes.
      All services are provided on an “as-is” and “as-available” basis. We make no warranties or guarantees regarding service results, delivery times, or product condition upon receipt.
   9. Order Cancellations and Refunds
      Please note that while service orders (such as grading and restoration) are strictly non-refundable and non-cancellable once confirmed, product purchases may be eligible for return or refund only under the specific conditions and timeframes outlined in our Return, Refund and Delivery Policy.
   10. Shipping and Delivery
       Shipping fees and estimated delivery times are determined based on your location and the selected shipping method at checkout. While we strive to ensure timely delivery, Pokey Mart is not responsible for shipping delays or issues caused by third-party courier services unless Pokey Mart is proven at fault prior to dispatch.
       Risk of loss and title for all products transfer to the customer once the package is handed over to the shipping carrier.
   11. Modifications to the Terms
       We reserve the right to update or amend these Terms at any time, without prior notice. The most current version of the Terms will always be available on our website. By continuing to use our services after changes are made, you accept and agree to the updated Terms.
   12. Termination
       These Terms of Service shall remain in effect unless and until terminated by either party.
       You may terminate this agreement at any time by notifying us that you no longer wish to use our services or by ceasing all use of our website and services. We reserve the right, at our sole discretion, to suspend or terminate your access to our services at any time and without prior notice, if we reasonably believe that you have violated any provision of these Terms. Upon termination, you will remain responsible for any outstanding obligations or payments incurred prior to the termination date.
       All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

       These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes, claims, or legal proceedings arising from or related to these Terms shall be resolved exclusively in the courts of Malaysia.
